Vogue Sues Drake for Spreading Fake Magazine Covers to Promote ‘Her Loss’ Album

Instead of doing the usual media blitz to promote his new album, “Her Loss,” Drake instead manufactured fake covers and even interview clips with several outlets. Howard Stern loved the result, but Condé Nast, the publisher of Vogue, hit the rapper and his collaborator 21 Savage with a lawsuit over the stunt.

The suit against the rappers was filed Monday. It alleges “flagrant infringement” of Vogue trademarks and for the implication that the magazine endorsed the album, which was released on Nov. 4.

Drake and 21 Savage shared the faux Vogue magazine on Instagram on Oct. 30 and also distributed physical copies in several cities. They thanked and tagged editor-in-chief Anna Wintour in the post: “Me and my brother on newsstands tomorrow!! “Thanks @voguemagazine and Anna Wintour for the love and support on this historic moment.”

“All of this is false. And none of it has been authorized by Condé Nast,” the lawsuit states. “Vogue magazine and its Editor-in-Chief Anna Wintour have had no involvement in ‘Her Loss’ or its promotion, and have not endorsed it in any way.”

According to the suit, the “deceptive” magazine has caused “unmistakable” confusion and “underscores the tremendous value that a cover feature in Vogue magazine carries.”

Before filing the suit, Condé Nast “repeatedly” asked the rappers to “cease their infringing activities and take appropriate remedial measures to curtail further public confusion.”

The lawsuit further alleges that the faux “Her Loss” Vogue magazine “is a complete, professionally reprinted reproduction of the October issue of Vogue, with unauthorized adaptations made in service of promoting defendants’ album. The counterfeit cover… provides no indication that it is anything other than the cover of an authentic Vogue issue.”

Drake’s public relations agency, Hiltzik Strategies, was also named in the lawsuit, but his publicist declined to comment to TheWrap.
